In the Name of God Amen. This 18th day of June in the year of our Lord one thousand seven hundred and ninety nine I Jacob Gass of Greene County and State of Tennessee being weak of body, but of good and perfect memory, Thanks be unto Almighty God -- And Calling to remembrance the uncertain state of this transitory life and that all flesh must yield unto death when it shall please to call -- do make, constitute, ordain and declare this my last will and testament in manner and form following, revoking and annulling by these present all and every testament and testaments, wills, and wills, heretofore by me made and declared, either by word, or writing, & this is to be taken only for my last will and testament, and none other -- and first being penetant and sorry from the bottom of my heart for my sins past most humbly desiring forgivings of the same. I give and commit my soul unto Almighty God my Saviour and Redeemer in whom and by the merits of Jesus Christ in whom I believe assuredly to be saved and to have remission and forgivings of all my sins that my soul with my body at the general day of Ressurrection shall arise again with Joy and through the merits of Christ death and passion possess, and inherit, the kingdom of heaven prepared for his elect and chosen, and my body to be buried in such a place where it shall please my Executor hereafter named, and now for settling my tempory estate and such goods and chattles and debts, as it hath pleased Almighty God far above my deserving it, bestow upon me I order give and dispose of the same in manner and form following that is to say. First I will that all those debts and ones that I owe in right or cons[ __ ] to any manner of persons whatsoever shall be will and truly contacted and paid, or ordered to be paid within convenient time after my Decease by my Executors hereafter named -- First of all I will and bequeath unto my loving and affectionate wife Mary my plantation one hundred and thirteen acres to have and to hold eleven years four months and thirteen Days. Then after the expiration of Said time the said plantation to fall into the possession of my son William for the space of nine years five months and seventeen days, then the plantation to be equally divided between the said William my son and Jacob my son for them either to divide the land and both have an equal part or otherwise the one to pay the other one half of the worth of said land which ever way they may think best -- I also will that my wife Mary have the still and the vessels until my son William arrives to the age of Twenty one, then after that time the still and the vessels to be the property of my son William & Jacob, under the same rules and restrictions as the land, unless the Child that my wife Mary is now with be a boy, then and in that case, the still and vessels to be his property, and to be sold to the highest bidder the principal and interest to be his when he comes of age. I also will that my wife Mary have the crops now growing only she is to cause to be made up as much out of seed crop and fruit as will be sufficient to pay all my past debts. If the bonds and notes which I have on William Dinwoody, William Waley and George Johnson be be not sufficient. Likewise she is to have all the household furniture except Jeane wheel and bed together, with the white mare, two milch cows of her own choosing, the Bull six head of sheep and all the Hogs, and also the [ ___ ] colt, to be the property of Mary my wife on condition that she -- spends the value thereof on the education of my children and in a particular manner, my sons I also will and bequeath unto my daughter Jane one spinning wheel and bed, one cow and calf. The said cow commonly called her own, two head of sheep, and the young colt that came of the Gray mare, I also will and bequeath that my daughter Margaret have the black cow and calf and calf and little wheel and five sheep. The said property to be sold to the highest bidder until the said Margaret my daughter arrives to the age of eighteen. I also will that my Bay horse, four head of sheep and one two year old heifer, Sd property to be sold to the highest bidder for the use of the three youngest children. That is to say Sarah, Susannah and the one that my wife is now with to be equally divided amongst them as they come of age, but rather than my children should suffer in their non-age, there in that case my Executors to make use of said property for the benefit of said children to prevent them from being bound out to strangers, I also will and bequeath unto my Mother Gass, have the dark spotted heifer, I also will that my Executors have all the bonds, and notes that is coming to me from from any persons to enable them to discharge my just debts -- I also will desire and appoint my loving wife Mary my brothers, John and James Gass, my true and lawful Executors to see that this my last will and testament be acted upon agreeable to the contents thereof in witness there of I have hereunto set my hand and seal the day and year first above written.
