    Probate case #4026 administrator W.B. Evans Box 235 In the matter of the estate of W. E. Evans, Deceased. In the County of Cooke County, Texas. Now on this the 21st. day of December, A.D. 1931, came on to be heard the application of W.B. Evans for the probate of the last will and testament of W.E.Evans, deceased, which will bears date of November 19th, 1931, and which will and said application were filed in this court on December 5th, A.D. 1931, and it appearing to the court that citation upon said application and the filing of said will has been issued, served and returned in the manner and for the length of time required by law, and it further appearing to the court that the said testator, W.E. Evans, is dead and that he died at his home in Cooke County, Texas, on December 1st A.D. 1931, and that he left an estate consisting of real and personal property all of which is situated in Cooke County, Texas, where he resided and had his domicile and fixed place of residence at the time of his death, and that the said decedent executed said will with all the formalities and under the circumstances required by the law to make it a valid will, and that said will has not been revoked by the said testator, and it further appearing to the court that the said W.B. Evans was named in said will as the sole and independent executor thereof, and that he is entitled to letters testamentary upon the estate of said decedent, and that he is not disqualified by law from receiving and accepting letters testamentary upon the estate of the said decedent, and that there is a necessity for administration upon said estate. It is therefore ordered, adjudged and decreed by the court that the said last will of said W. E. Evans, deceased, bearing date of November 19th 1931, be and the same is hereby admitted to probate and record as the last will of the said W. E. Evans, deceased, and that the testimony of W. E. Purcell, on of the subscribing witnesses thereto who proved asid will, be recorded by the clerk of this court in the Probate Final Records of this court, and that the provisions of said will be confirmed and that letters testamentary upon said estate be granted to the said W. B. Evans. It is further ordered by the bourt that S. W. Gibson, Jas. R. Bell and J.H. Purcell be and they are hereby appointed appraisers fo said estate. B.F. Mitchell-Judge of the County Court of Cooke County, Texas Inventory and Appraisement of the Estate 160 acres of land in Cooke County, Texas, out of the Edward Brother Survey, Abst. No.78 valued at $ 1,600.00 84.52 acres of land in Cooke County, Texas, out of the A. Eubanks survey, abst. no. 355, valued at $845.20 Certificate NO. 178 in Series No. 1, of Cooke County Mutual Aid Association of Gainesville, Texas valued at $ 950.00 Money in the First National Bank of Gainesville, Texas $404.73 TOTAL: $3799.93

    WILL State of Texas, Cooke County; Know All Men By These Presents: That I, W.E. Evans of the state and county above mentioned, being of sound mind and memory do hereby make and declare this to be my last will and testament hereby revoking all former testamentary writings made by me. First:- I will, give and bequeath to my son Thomas E. Evans all the real property I now own out of the Alfred Eubands Survey Abstract 255 Pat. No. 1375 Vol. 11 situated about nine miles East of Gainesville, Texas. Second:- I will, give and bequeath to my son C. Newton Evans the East half of all the land or Real Property I own out of the Edward Brothers Survey Patent No. 1790 Vol. 9 including the old home log house, cribs, sheds and smoke house, but not including the two room Box house South East of the old home place. Third:- I will, give and bequeath to my son W.B. Evans the West half of all the land or Real Property I own out of the Edward Brothers Survey and including the two room Box house now located on the East half of said Edward Brothers Survey Patent No. 1790 Vol. 9 above given to C. Newton Evans, said house to be moved by my three sons from the East half to the West half of the said Edward Brothers Survey that I now own. I desire that my body be given a Christian burial suitable to my station in life and that my just debts including funeral expenses be paid out of my life Insurance and personal property and the remainder be equally divided amongst my three sons above named. I hereby nominate and appoint my son W.B. Evans to be sole executor of this my last will and of my estate to serve independent and without bond and I direct that no action shall be had in the County or Probate Court int he settlement of my estate except the probating and recording of this my will and the return of an inventory, appraisement and list of claims of my estate. In witness whereof, I have hereunto set my hand and mark which is my signature on this the 19th day of November A.D. 1931 in the presence of the undersigned person whom I have requested to witness the execution of this will.
