Last Will and Testament of Abe Kennedy
Death: 23 FEB 1926 in Meade Co., KY
Burial: Buck Grove Cemetery, Meade Co., KY
I, Abe Kennedy, now a resident of Meade County, Kentucky, being of sound mind and disposing memory and knowing the uncertainty of life and certainty of death do now hereby make this my last will and testament.
It is my will as follow:
FIRST. That my son, B. F. Kennedy, be allowed to qualify as executor of this my last Will & Testament and I direct that no bond or surety be required of him for or in executing the said trust. In event that said B. F. Kennedy should die before I die, or if for any reason the said B. F. Kennedy should fail to qualify or act then I direct that my son, Sam Kennedy, be allowed to qualify as executor of this my last Will & Testament and I also direct that in event that he qualifies as my said Executor that also no bond or surety be required of him.
SECOND. I direct my said Executor as soon after my death as he can reasonably do so that he pay all my just debts.
THIRD. I direct that my said Executor cause a suitable monument to be erected at my grave; not too expensive but do direct that a suitable stone for a man of my station in life be there erected.
FOURTH. I hereby give and bequeath to my beloved wife, Kitty Kennedy, the home place where we now reside, consisting of about 130 acres, and which said farm is located near Salem Baptist Church in Meade County, Kentucky, and which said farm was conveyed to me by two deeds of conveyance, one from Frank Shain and wife and the other from Steve McCoy and wife, or so much of the said farm as I may own and possess at the time of my death and the same is now hereby given and bequeathed to my said wife for and during her natural life with remainder to my children Viz: B. F. Kennedy, Jack Kenney, Same Kennedy, Mrs. Lillian Lamkin, Mrs. Mary Maxwell, Mrs. Kate Chism, Mrs. Neil Martin, Mrs. Bertha Philpott & Louise Kennedy.
FIFTH. I also give my beloved wife, Kitty Kennedy, the following personal property: One horse and buggy, four head of cows or cattle of her selection, one Ford Automobile, all house hold and kitchen furniture, 5 hogs and also the proceeds of my life insurance policy in the mutual benefit Life Insurance Company for the sum of $1,000.00. All of the above enumerated personal property is given to my wife to be hers absolutely.
SIXTH. As soon after my death as my Executor can reasonably do so he is directed to sell all of real estate not heretofore bequeathed in this will at either public, or private, sale, as he may think best and he is now given fully and complete power to deed and convey any or all of the residue of my said real estate other than what I have herein bequeathed to my wife for and during her natural life and when a deed or conveyance is properly executed by my said Executor it shall covey an absolute fee simple tile to the same. I also direct my said Executor as soon after my death as he can reasonably do so to sell the residue of my personal property after the special bequests to my wife have been made and satisfied, either public or private sale as he may think best. I direct that proceeds of the sale of both the residue of my real estate and the residue of my personal property as herein provided in this clause of my will be distributed as follows: - first: owing to the fact that I have heretofore made advancements to my other children at the times of their getting married, or shortly thereafter, of various articles and various amounts and for the further reason that Louise Kennedy is of tender age and a female; I direct my said Executor to first pay to her the sum of Two Hundred ($200.00) Dollars and I direct that the residue of the money arising from the sales as provided for in this clause of my Will be equally divided between my children Viz: B. F. Kennedy, Jack Kennedy, Sam Kennedy, Mrs. Lillian Lamkin, Mrs. Mary Maxwell, Mrs. Kate Chism, Mrs. Neil Martin, Mrs. Bertha Philpott & Louise Kennedy.
SEVENTH. All other personal property, including notes and money in bank, shall be equally divided among my children and whose names appear in clause six (6) of this will.
I commend my soul to God who gave it.
IN TESTIMONY WHEREOF WITNESS my signature this the 29th, day of August 1924.
