    Elisha Abbott made his will 28 Jan. 1837 and was dead by 24 April 1837.The court appointed sheriff Peter Rives to execute the estate 23 Oct.1837, as no one appeared to administer the estate.

    I Elisha Abbott of Halifax County Virginia being of sound mind anddisposing memory do make this my last will and testament in manner andform firm following that is to say.
    1st I lend my beloved wife Lydia Abbott one hundred & fifty acres of landto be taken in such a manner as to include the mansion house and any partof the plantation, also the following slaves to wit Thomas, Robin,George, Sarah, Charley and Mary and her three children Milly, Ben &James.
    2nd I have given to my daughter Elizabeth Hill a Negro woman Esther and agirl Dicy, one horse saddle & bridle to her and her heirs forever whichis her portion of my estate.
    3rd I give to my daughter Nancy Carr a Negro man Abrum and a woman Nellto her and her heirs forever.
    4th I have given to my daughter Polly Martin a Negro woman Coly a Negroman Bob, a horse saddle & bridle to her and her heirs forever.
    5th I have given to my daughter Martha Cooly a Negro woman Hannah and aboy Davy, a horse saddle & bridle to her and her heirs forever which isher portion of my estate.
    6th I have given to my daughter Sally Richardson a Negro girl Sarah andgirl Irene, a horse saddle and bridle to her and her heirs forever.
    7th I have give my daughter Rebecca Dawson two Negro girls Tesby andJudy, a horse saddle and bridle to her and her heirs forever.
    8th I have given my daughter Annis Abbott two Negro girls Delily andNancy, a horse saddle and bridle to her and her heirs forever.
    9th I give and bequeath to my daughter Alice Abbott one hundred & fiftyacres land commencing at the upper part of Charles S. Davenports line andcrossing the creek to William Walnes line, a Negro woman Chany & herchildren Rhoda, Aggy and Peter, a horse saddle and bridle to her and herheirs forever.
    10th I give and bequeath to my son James Abbott the balance of my landand his mothers dower at her death, a Negro man George and a boy Joe, ahorse saddle and bridle to him and his heirs forever.
    11th at the death of my wife I give the Negro man George loaned her to mydaughter Alice Abbott and the Negro woman Mary and her three childrenMilly, Ben and James & her future increase to my son James Abbott and thebalance of the Negroes loaned her and their increase to my daughtersNancy Carr, Polly Martin, Sarah Richardson, Rebecca Dawson & Annis Abbottto them and their heirs forever.
    12th I do hereby appoint my friend James as executor to this my lastwill and testament, hereby revoking all others heretofore made intestimony whereof I have hereunto set my hand and seal this 28th day ofJanuary 1837.

    Pvt. Elijah Abbott enlisted in Stafford County on 18 March 1781 in Capt.Joseph Scott, Jr. Company of the First Virginia, for eighteen months. Hewas first under Lafayette and then Col. Christian Febiger. There was aLt. Nathaniel Darby listed as one of his officers. (could this be the sonof John Dalby the father also of Nancy Dalby who married MacajahBullock?) This reference was taken from "The First Virginia Regiment ofFoot" 1775-1783 by M. Lee Minnis
    -- Elijah was transferred from Capt. Scotts Company into Capt. ThomasMartin's Company. He transferred from Col. Febiger's regiment to Col.Thomas Posey's until discharged at Cumberland Courthouse in 1782. Hispension application was made in Bourbon County Kentucky on 24 August1824. His wife was aobut 64.

    Cooley of Roane Co. John Cooley died intestate in Roane Co. leaving twochildren Elisha, about 3 or 4 at the time, and Lydia still a minor, and awidow Martha who has sinc married Hamilton Stewart and the Stewarts andLydia live in McMinn Co. 1845, witness Amos Marney, 55, in Roane Co. saysElisha was raised by his grandfather James Cooley and Grandmother Cooley.1844 in Monroe Co., witness Robt. Cooley, 52, and Martha Cooley,75; JohnCooley died Nov 1825; John's new wife's father Elisha Abbott gave Johnthe slave, Martha Cooley says Elisha stayed at her house except for oneyear. Other witnesses say Elisha lived with Stewarts several years.Elisha Abbott father of Martha Stewart died testate after John Cooleydied.

    81Elisha was born in Halifax County, the eldest son of Benjamin Abbott.He was too young to fight during the Revolution, but since his dadprovided some beef to the Army, they must have been patriots. In 1783 hisfather gave him 170 acres on Bye Creek in the western part of the countynear Elkhorn and five years later he got 100 acres nearby on a branch ofthe Banister River apparently Bradley Creek.1465,1466

    Elisha Abbott, whom we believe was born about 1760, married Lydia Clay inHalifax County 29 October 1793. Margaret Clay consented to her daughtersmarriage and Rev. Hawkins Landrum performed the wedding ceremony. JamesClay and Margaret Muses brother Hopkins Muse were bondsmen. Her father,James, came from Chesterfield County to Halifax and settled on CatawbaCreek about a dozen miles north of where my father lived.

    The Abbotts attended Banister Baptist Church, which served bothPittsylvania and Halifax counties. At a Church Meeting at Elkhorn 28 June1828 appointed Charles Clay to cite Elisha Abbott and wife to attend ourmeeting in July at Rices. Several Clay family members were in thecongregation.

    Elisha still owned 170 acres upon which Halifax County taxed him in 1800.During his lifetime only men who owned land could vote, so he qualifiedin 1800 and 1808.1467

    He made his will in Halifax County in January 1837 bequeathing nearly 30slaves to his wife, 8 married daughters, and their only son. Eilsha diedwithin a month or two.

    Lydia sold her interest in land on Bradley Creek that Elisha left her inhis will 4 January 1842,1468 and left for Lincoln County, Missouri, tolive with her daughter Alice.
