    John was the eldest son. He served as a Member of The Council. His will is recorded in the City of Fredericksburg Records.

    From "The Armistead Family": "A deed June 24, 1703, in York County Court from John Smith of Abington Parish to brother Lawrence Smith reciting a clause of their father's will "Lawrence Smith late of Glouchester the testator gave 1300 acres in Abington parish to John Smith and his lands in York parish and County to his son Lawrence Smith and remainder to his grandson, who died Oct. 12th 1701."

    In 1691, Major Smith laid out the town of Yorktown on land that belonged to Benjamin Reade. Maj. Lawrence Smith and his wife, Mary, of Gloucester, gave, on the 12th of June, 1691, two plantations in Gloucester to their son, John Smith, who was succeeded by his son and heir, Lawrence Smith.
