!Will of Jacob Albright of Shelby Co., IN, 14 Apr. 1861
I Jacob Albright of the County of Shelby and State of Indiana considering the shortness of life and the certainty of death and desiring to convey my worldly concerns while in health and now being of sound mind and memory do hereby constitute this my last will and testament revoking all former wills by me at any time made. First I desire that after my decease my boddy shall be buried in decent Christian like manner and all funeral expences paid. Secondly as to the worldly goods that God has blessed me with, first being possessed of forty acres of land more or less on which I now reside, I desire that the above land shall be my wife Rachels land during her lifetime or while she remains my widow. I also give unto my said wife all my personal property while she remains my widow and at her death I desire that all my land and other property shall be equal (sic) divided between all my children, namely to wit, Malindy now the wife of Steven S. Lewis, also Sarah now the wife of Merit Lewis, also James Albright, also John Albright, also Jacob Albright, also Mary now the wife of William Duvall, also Louisa now the wife of Robert G. Swails, Jr. I also devise that Robert G. Swails, Junr., shall be my administrator. Given under my hand this fourteenth day of April in the Year of our Lord 1861. Jacob Albright

Swails whose proofs together with such will have been duly recorded on pages 71 & 72 of the record of wills in my office.

!Note on Jacob Albright's will. There are two handwritten copies of Jacob's will. One is dated 14 Apr. 1861 and the other is dated 14 Apr. 1862. Since both are dated 14 April it is most likely that one of the copies was misdated when it was copied. Since Rachel died 18 Aug. 1861 and since she was mentioned in the will dated 14 Apr. 1861, it is obvious that 1861 is the correct year for the will. A copy of the will dated 1862 was sent to me by Maymie F. Glasgow, 2229 Churchill Rd., Okla. City, OK, 73120. Unfortunately it is not a complete copy of the will but it does have a first and a last page. The portions that are there seem to read the same as the entire copy of 1861 and since both copies are dated 14 Apr. it is unlikely that Jacob revised his will because of his wife's death, nor was it necessary to do so.
The New Bethel Cem. is at the edge of the town of New Bethel (also called Wanamaker) a few miles from the town of Pleasant View and in the adjoining County of Marion.
